Insurance companies and pension funds will not be able to distinguish between men and women, agree deputies

PRAGUE (MEDIAFAX) - Determination of premiums based on gender or different calculations of retirement pension based on mortality statistics for men and women will probably soon be past. The House on Tuesday sent a standard that from 21 December 2012 unequal treatment of disabled and gender will punish him in the second reading.

"This is another anti-discrimination under the European Union flag. Already we have managed to enact such that women can go down the pit. Imagine the horror, women could not go down the pit! And now we have this standard," he commented in a discussion Petr Braný (Communists).

In practice, the law mean that women raise the price of insurance, in some cases up to 80 percent. Still paid less because on average live longer than men and are less risky for insurers.

Insurance Contract Act has understood the principle of equal treatment only reserved. Insurance companies are able to determine the amount of the premium and the insurance benefit calculation used in addition to age and health status and gender. Similarly, pension funds providing insurance with state contribution could legally modify the amount of pensions according to mortality tables separately for men and especially for women, who statistically live longer.

After 21 this December straightforward sexual division under the amended Act will end, at least for new contracts.

Czech National Bank will be able to an insurance company for discrimination against men or women punish 100tisícovou fine, repeated offense will be punished by penalties of up to five hundred thousand crowns.

The law on pension insurance with a state contribution falls sentence again about the possibility of the use of different mortality tables for men and women. In this case, standard pension fund to punish by a fine up to five million.

Even after the changes dictated by the unification of European legislation, but the gender of insurance completely lost. Financial institutions it will be able to continue to use as a general risk factor.

Specifically, insurance companies will be able to continue to use the data on the sex of their clients for the calculation of reserves and inner determination of the total equity premium, determining the amount of collateral, advertising and marketing as well as life and health insurance.

Insurers will thus remain free to focus advertising on either men or women. But will not be able to deny access to specific products only on the basis of gender candidate.Life and health insurance, will not be able to vary between two different people with the same insurance policy solely because of their sexual differences.

An example is a family history of breast cancer, which does not have the same impact on the health risks of men and women. Obesity is a risk factor, then, when the measurement is used the ratio of waist: hips, which is not the same for women and men.

The House standard, receipt requested Brussels, instructed to discuss the Budget Committee and the Committee on Health and shorten the consultation period to 30 days.
