100 million fine for the cartel pays four companies in the field of waste management


PRAGUE (MEDIAFAX) - A total of four companies in the field of waste management received from the Office for Protection of Competition (OPC) the aggregate fine of 100 million crowns. Firms ASA, van Gansewinkel, SITA CZ and CZ AVE Waste Management entered into pursuant to Wednesday's Information Office cartel.

"Competitors operating in the waste management market and some even maintenance of roads they allocated market through manipulation of the tendering process, which led to a distortion of competition. Verdict containing the prohibition of anti-competitive agreements and fulfillment of that penalty is final," said Chairman of the Office Petr Rafaj.

The resulting penalties for individual members of the cartel, which is based on their turnover generated in the markets concerned are as follows: ASA, spol. Ltd. - 24,289,000 crowns, van Gansewinkel, as - 10,870,000 crowns, SITA CZ, as- 19,753,000 crowns, waste management AVE CZ, sro - 41,667,000 crowns.

Office revealing prohibited agreements based on its investigation in September 2010 initiated administrative proceedings with ASA, SITA and van Gansewinkel. Last year, the proceedings were extended by company AVE. The Office investigation found that the competitors have between 2007 and 2011 (SITA and van Gansewinkel only in the years 2008 to 2010) through mutual contacts and exchanges of information allocating customers among themselves when coordinating their actions in public procurement in the field of waste management , respectively. road maintenance.

Agreements have been concluded between all parties at the same time, it was six bilateral agreements that are attached to customers and procurement process in waste management for companies AVE ASA and also the procurement of road maintenance.

ASA and AVE during the administrative procedure applied for the application of so-called leniency program. In exchange for providing substantial evidence of anticompetitive conduct have been reduced by 50 penalties, respectively. by 30 percent.

All parties moreover requested on the application of the so-called settlement, under which acknowledged the facts and legal classification defined by the Office, for which they have been reduced by 20 percent penalty.
