Office imposed a fine of 93 million Telefónica CR


PRAGUE (MEDIAFAX) - The abuse of its dominant market position to order the Office for Protection of Competition (OPC) a fine of 93 million telecommunications company Telefónica CR Office about the center reported on its official website.

"Telefónica CR we awarded a penalty exceeding 93 million for abuse of dominant position on the market for the provision of public telephony services for businesses through public fixed telecommunications networks. Decision is not yet final and may be filed against him," he said on his website Office.

Former Czech Telecom infringement of the competition rules under authority committed in 2001 and 2002, albeit with nearly 3,000 businesses contracted to provide pricing plans.In these contracts, the customer is obligated proclaim every month minimum specified amount of calls that had to be paid, even though the volume of calls fully exhausted.

Contracts also could not be terminated by the customer before the closing date specified in the contract, and customers also were not allowed to use voice services from a different provider than the Czech Telecom. "Furthermore competitor against some individual customers apply different conditions from those of standard pricing plans for entrepreneurs and also applied programs Winback / Retention in order to obtain or retain customers at the expense of competitors," adds the report of the Office, with the described conduct Czech Telecom distorting competition period when there was a public interest in the liberalization of the telecommunications sector.

The case then nearly eight years of administrative decisions in which courts have issued five judgments. The latest judgment of the Regional Court in Brno from April 2011 confirmed the findings of the Office of factually that the company abused its dominance, but canceled part of the penalty with the fact that the fine is not adequately justified.

The Authority, therefore, in the latest decision focused mainly on a detailed calculation of the penalty. Severity was taken into account as anticompetitive conduct, duration and repeated violations of the law by the subscriber.

Office for the Protection of Competition is the central state administration of the Czech Republic, with responsibilities for the protection of competition, supervision over public procurement, and monitoring and coordination of public support. The Office is managed by the Chairman, who is appointed by the President of the Republic for a six-year term.

Telefonica shall decomposition. The fine represents approximately 1.3% of the expected net profit for the year 2012 and, therefore, the message is considered as minor adverse with minimal impact on performance.
