Direct election of the president will take part in Bobošíková, the Supreme Administrative Court (14 December 2012)

PRAGUE (MEDIAFAX) - The Supreme Administrative Court (SAC) on Thursday ruled that the Interior Ministry to register Jan Bobošíková (Sovereignty) as a candidate for the direct election of the president. On the contrary, the court failed complaints economist Vladimir Dlouhy and Senator Tomio Okamura.

NSS objection thus recognized that the Department erred in calculations. This is the error rate in the two control samples with each candidate, which reduces the total number of signatures, counting instead be averaged. Bobošíková so after a modified calculation needed over received 50,000 votes, according to the court decision it must register ministry.

The decision of the judges of the Interior Ministry responded on Thursday afternoon and candidate John Bobošíková to officially registered direct presidential election.

In the case of Vladimir Dlouhy and Tomio Okamura, the court held that the error of their signature sheets are so high that even after re-calculated number of signatures is less than 50,000, and their complaints were thus rejected.

Šimíček further stated that the decision was a difficult period of 15 days is relatively short. SAC's decision in the case of Long, Bobošíková and Okamura, however, was not unanimous. Of the seven-member electoral Appeal, three judges disagreed with the majority verdict.

"We were convinced from the start that the law on the election of the President of the Republic is not in conformity with the constitutional order that has serious deficits," the judge said Josef Baxa, with the election of Appeal to stay the proceedings and refer the matter to the Constitutional Court with a petition to repeal the specific provisions of this Act.

And at the Constitutional Court case maybe one of the unsuccessful candidates ends. SAC's decision is final and is the only option that long with Okamura left is to file a constitutional complaint. But that would jeopardize election date 11th and 12 January 2013.

NSS also rejected the complaints of six other applicants and unofficial candidates but by far not reached the required number of 50,000 signatures.
