Members approved the final reading of the law on victims of crime

PRAGUE (MEDIAFAX) - The right to receive professional help, to protect privacy, but also the right to higher compensation comprehensive legislation defining the new law on crime victims, which on Tuesday Chamber of Deputies approved the third reading. The law is intended to help victims cope with the consequences of the crime as the least painful.

The controversial proposal from the Chair of the Group of Marek Benda (ODS), which could postpone the real-world performance of the Act for several years, eventually ruled Deputies, Deputy proposal downloaded. According to the amendment, the new rules apply not already pending. "This bill is an example of the government only definitely not being discarded, as the opposition likes to say, but managed wisely and effectively, because it can increase their financial support where it is really needed," said Justice Minister Pavel Blazek (ODS).

MEPs approved the amendment of the former Justice Minister Jiri Pospisil (ODS), which reflected the new Civil Code. Newly and victims of crime receive from state 10 thousand in the case of slight bodily injury, 50,000 crowns in serious physical injury and 200 thousand survivors if the victim dies. "This financial assistance from the state does not address compensation for injury victim can require the offender, it is a bonus, by which it can operate immediately, to fund a lawyer or other services," said Pospisil, that this is a historic moment.

The current legislation, which concerns of victims of crime, according to former minister fragmented. "This is a completely new law. Still the issue of crime victims incompletely adjusted in legislation such as the Criminal Procedure Code. The fact that we have a separate comprehensive law to operate with any victim of the offense, we approach the other countries of Western Europe, where the criminal is the victim always preferred and strongly protected, "Pospisil said earlier.

A key change is the introduction of a right to receive professional help. "At first glance it looks like something that already exists today, but unfortunately for the standards of Western Europe to catch up," said Pospisil.

Professional help should be on the lines of managing both the nonprofit sector and should be expanded powers probation and mediation service.

"The right to financial assistance arises, even if the matter was postponed because the perpetrators could not be identified or it may be criminally prosecuted for insanity, lack of age or lack of consent of the competent authority to the prosecution or because of a pardon or if it is aoffender who is excluded from the powers of law enforcement or because the offender has died, "says Bill.
"Claims for damages or non-pecuniary damage against the perpetrator will now move to the state, to the extent of the assistance," proposed by the Ministry.

Victims of crime have the right to control newly accompaniment trustee, which may be close to a person. The main purpose of the presence of a confidant, the psychological help. "Confidence can not be the one who in the proceedings of an accused, the defense counsel, witness, expert or interpreter," says the law.

The Justice Department in the preparation of the law inspired example of Switzerland, Canada and Germany, where the issue is treated by a separate law.
